Ferry County Commissioners Pass Surprise OHV Ordinance

In light of Quiet Communities Coalition’s legal challenge to the OHV Ordinance 2007-22, the Ferry County Commissioners have passed a new OHV Ordinance 2008-06. The new ordinance contains the same flaws as the previous versions.

 

Key points:

  • The new ordinance still designates roads that do not meet the legal requirement for designation; they must connect an “OHV facility” to a city of less than 3,000.
  • Many roads are now designate the "entire route".
  • Enforcement is still not available and will be costly. Although fines and penalties are included in the new ordinance (indication that there is likelihood of violations) the Ferry County Sheriff’s office stated that they may have to park vehicles due to gas prices. When the first ordinance was passed, the Sheriff’s office did not have map or description of designated routes.
